Article 1 Preliminary Provisions
These Terms of Service govern the use of La French Academy website, operated at https://french.academy (hereinafter: “Website”), including:
- publication of blog and educational content,
- booking and conducting individual French language lessons (“Lessons”),
- purchase of paid digital materials through the paywall.
The Service Provider is Bartosz Garliński Koncept, ul. Opłotkowa 11, 51-007 Wrocław, Poland, Tax ID (NIP) 898-182-11-36, REGON 363414246, e-mail: l@french.academy, tel.: +48 517 943 491 (hereinafter: “Service Provider”).
The contract for the provision of electronic services is concluded upon commencement of use of the Website; acceptance of these Terms of Service is a prerequisite for using the full functionality, including booking Lessons.
Minimum age of User is 16 years.
Single Point of Contact (DSA). In accordance with Article 11 of Regulation (EU) 2022/2065, the Service Provider designates the e-mail address l@french.academy as a single point of contact for state authorities and users regarding information society services.
Article 1a Definitions:
For the purposes of these Terms of Service, the following definitions apply:
- User – any natural person who uses the Website;
- Consumer – a User within the meaning of Article 22¹ of the Polish Civil Code;
- Entrepreneur – a User who is not a Consumer;
- Paywall – part of the Website requiring prior payment or Subscription for access;
- Subscription / Club BCBG – recurring service provided under the terms of Article 6a;
- Billing Period – the unit period for which the subscription fee is charged (calendar month);
- Business Day – a day from Monday to Friday, excluding statutory non-working days in Poland;
- Force Majeure – an external event, independent of the parties, which could not have been foreseen or prevented.
Article 2 Type and Scope of Services
- Educational content (articles, exercises, videos, podcasts).
- Lessons conducted online via Nakiedy.pl (bookings), communicators (Zoom, Teams, etc.) and Przelewy24 payment gateway.
- Paywall and file repository on Zanfia.com operated by Stripe (premium downloadable materials).
- Chatbot for language learning (Claude AI).
- Visit statistics – Google Analytics.
- Hosting services – CyberFolks.pl.
- Nature of content. Responses generated by the Claude AI chatbot are for educational purposes only and do not constitute professional advice.
- Limitation of liability. The Service Provider is not liable for consequences of using information generated by the chatbot.
- Notice-and-action procedure (DSA). Users may report unlawful or illegal content by sending a message to l@french.academy with justification. The Service Provider will make a decision within 72 hours.
Article 3 Technical Requirements
- Users should have a device with Internet access of at least 10 Mb/s bandwidth, microphone and camera enabling participation in Lessons.
- The Website is supported in current browser versions (not older than the last two stable versions): Chrome, Firefox, Edge, Safari.
- Full functionality requires enabled cookies and JavaScript. Disabling these features may limit Website operation.
- The Service Provider does not guarantee proper operation in browsers, operating systems or devices withdrawn from official manufacturer support.
Article 4 Registration and Account
- Accounts are created in the Nakiedy.pl system.
- Users undertake to provide truthful data and keep it updated.
- Personal data is processed in accordance with the Privacy Policy.
- Account security. Users are obliged to keep login credentials confidential and not to share accounts with third parties. In case of suspected unauthorized access, users should immediately change their password and inform the Service Provider.
- Age verification. Accounts may be created by persons aged 16 and over; persons aged 16-18 declare that they have the consent of their legal representative.
- Account suspension. The Service Provider reserves the right to temporarily suspend an account in case of unauthorized payment (chargeback) or serious violation of these Terms until the matter is clarified.
Article 5 Booking, Payments and Conducting Lessons
- Bookings must be made at least 24 hours before the scheduled time, no earlier than 90 days before the Lesson.
- Payment in advance via Przelewy24 or prepaid card.
- Cancellation possible only online no later than 24 hours before start – payment transfers to the next session. Later cancellation results in loss of payment.
- User delay ≤ 15 min shortens Lesson duration; delay > 15 min – Lesson is forfeited.
- Technical problems on either side: Lesson extended or rescheduled (individual arrangements).
- Refunds in special cases, according to formula: number of unused Lessons × unit price.
Article 6 Paid Material / Paywall
- Digital material download possible after successful Stripe transaction payment.
- Due to the digital nature of the product, the right of withdrawal expires after its provision (Article 38 point 13 of the Consumer Rights Act).
Article 6a “Club BCBG” Subscription
- Nature of service:
The Service Provider offers a paid, monthly renewable subscription called “Club BCBG” (hereinafter: “Subscription”), which provides Users with:
a) access to content marked in the Website as covered by the paywall,
b) access to the file repository for download (Club BCBG knowledge base),
c) ability to participate in recurring online group meetings on Zoom dedicated to learning French. - Contract conclusion
The Subscription contract is concluded upon successful order placement in the Zanfia.com module and payment of the first billing period via Stripe. By placing an order, Users:
a) consent to immediate commencement of digital services provision before expiry of the withdrawal period, and
b) acknowledge loss of the right of withdrawal after full contract performance (Article 38 point 13 of the Consumer Rights Act). - Billing period and payment:
– The Subscription renews automatically every month (“Billing Period”).
– The fee is charged in advance on the first day of each Billing Period using the payment method saved in Stripe.
– Prices are quoted in Polish zloty and include all applicable taxes. The Service Provider is VAT-exempt; VAT invoices are issued upon request after receiving company details. - Access and use
– Access to Subscription content and functionalities is activated immediately after payment confirmation.
– The license is non-exclusive and non-transferable; materials and access credentials may not be shared with third parties.
– Group meetings are held according to the schedule published on the Website; the Service Provider reserves the right to change dates for valid reasons (with advance notice). - Withdrawal from contract
– Consumers may withdraw from the Subscription within 14 days, provided the service has not commenced before expiry of this period.
– After service commencement, Users bear costs proportional to the period used (Article 35(1) of the Consumer Rights Act). - Cancellation and disabling automatic renewal
Users may cancel the Subscription at any time by disabling automatic renewal in the Zanfia panel or by contacting the Service Provider. Cancellation is effective at the end of the current Billing Period; fees for the commenced period are non-refundable (except as per section 6a.5). - Price or service scope changes
– The Service Provider may change the Subscription price or service scope for valid reasons (e.g., inflation, expanded offering).
– Changes will be notified at least 14 days in advance; non-acceptance allows cancellation without additional costs. - Suspension or termination by Service Provider
The Service Provider may suspend or terminate the Subscription with immediate effect in case of material breach of these Terms (e.g., sharing materials, non-payment). In such case, the fee for the current Billing Period is non-refundable. - Complaints
Complaints regarding the Subscription are handled according to the procedure in Article 7 of these Terms. - Final provisions
– Matters not regulated in this article are subject to other provisions of these Terms.
– The Service Provider may temporarily restrict access to Subscription content for technical reasons, making efforts to keep interruptions as short as possible.
Article 7 Complaints
- Complaints regarding Lessons, Subscriptions or other services should be sent to l@french.academy or by mail. The email subject line should contain the word “COMPLAINT” and the order date.
- The Service Provider will process the complaint and respond within 14 calendar days of receipt. Failure to respond within this period means acceptance of the complaint.
- Users may use out-of-court dispute resolution (UOKiK, ODR).
Article 8 Copyright
All Website content is protected by copyright law; copying and further distribution without the Service Provider’s consent is prohibited.
Article 9 Limitation of Liability
- Website content is educational in nature and does not constitute professional advice.
- Despite due diligence, unintentional errors or outdated information may occur. In case of doubt, please contact us.
- The Service Provider is not liable for access interruptions caused by factors beyond its control (operator failures, attacks, force majeure).
- Limitation of financial liability. The Service Provider’s liability to Users, regardless of legal basis, is limited to the total amount of fees paid by that User in the last 12 months, excluding intentionally caused damages.
- Exclusion of indirect damages. The Service Provider is not liable for lost profits or indirect damages.
- Force Majeure. Parties are not liable for non-performance or improper performance of the contract caused by Force Majeure.
Article 10 Changes to Terms of Service
- The Service Provider may change these Terms for valid reasons (e.g., changes in law, payment services).
- Information about changes will be published on the Website with 7 days’ notice.
- Using the Website after the effective date of changes means acceptance of the new content.
Article 11 Applicable Law and Jurisdiction
- Polish law applies to contracts.
- For matters not regulated, the following apply:
- Act on the provision of electronic services,
- Consumer Rights Act,
- Civil Code,
- Regulation (EU) 2022/2065 – Digital Services Act (from February 17, 2024).
Article 11a Severability
- If any provision of these Terms proves invalid or ineffective, it does not affect the validity of other provisions.
- In such case, the parties shall replace the invalid provision with a provision as close as possible to the original economic and legal purpose.
