Pierre : Oui, enfin… j’espère qu’on va y arriver.
Marie : Ah bon ? Tu changes d’avis maintenant ? On en avait pourtant parlé…
Maître Dubois : Du calme, du calme. Quelle est la valeur estimée du bien ?
Pierre : L’agent immobilier a dit 450 000 euros. Donc ma moitié fait 225 000.
Marie : Zut, Pierre !
Maître Dubois : Il existe d’autres solutions.
Marie : Ah bon ? Depuis quand ? Tu m’en avais jamais parlé !
Pierre : Euh… depuis six mois. Bon, c’est pas grand-chose, hein ! Juste 20 000 euros de parts.
Maître Dubois : Il faudra déclarer tout ça, Pierre. Pas de cachotteries dans un divorce !
Marie : Ben dis donc !
Marie : 180 000 ? Et je trouve ça où, moi ? Ma sœur peut me prêter 50 000, maximum.
Vraiment ?
Pierre : Ben quoi, c’est normal ! Allez, 2% par an, c’est raisonnable.
On progresse. Et pour les meubles ? La voiture ?
Pierre : La BMW, elle est à moi ! Je la payais avec mon salaire.
Marie : Chouette !
Pierre : On sait jamais, hein !
English translation
Marie and Pierre, married for fifteen years, have decided to divorce amicably. They meet at their notary, Maître Dubois, to discuss the division of their assets and their Parisian apartment. The situation seems cordial at first, but some points of disagreement quickly appear.
DIALOGUE
Maître Dubois : Hello Marie, hello Pierre. Please have a seat. So, you wish to proceed with the division of your assets as part of your divorce, is that correct?
Marie : Exactly. We’d prefer to settle this between us, without conflict.
Pierre : Yes, well… I hope we’ll manage. Um, where do we start?
Maître Dubois : Let’s start with the apartment. According to the file, you are equal co-owners of a four-room apartment in the 15th arrondissement?
Marie : That’s right. But, Pierre, we had agreed I could keep it, hadn’t we?
Pierre : Well yes, but I’ve been thinking… I mean, it’s still our main investment. You can’t just buy me out like that!
Marie : Oh really? You’re changing your mind now? We’d already talked about it…
Maître Dubois : Calm down, calm down. What is the estimated value of the property?
Pierre : The real estate agent said €450,000. So my half comes to €225,000.
Marie : Oh, Pierre! You know very well I don’t have that kind of money! And besides, the children live with me, they need stability.
Pierre : Listen, Marie, I also need that money to find somewhere to live. We can sell it and split it, can’t we?
Marie : Oh come on! Emma and Lucas are already upset enough by our separation. Do you want to uproot them as well?
Maître Dubois : There are other options. Pierre, would you accept payment in installments? Or compensation with other assets?
Pierre : Uh… maybe. What else do we have of value?
Marie : Well, there’s your watch collection, your stocks, the second home in Normandy…
Pierre : My collection? Oh no, that’s personal! And the house in Deauville – we inherited it from my parents!
Marie : Huh? It’s in both our names! And your watches – you bought them during our marriage; they’re marital property!
Maître Dubois : Marie is right regarding assets acquired during the marriage. Pierre, the house is also part of the marital estate if it is in both your names.
Pierre : Pfft… Fine, okay about the Normandy house. But my watches – they’re my passion!
Marie : Your passion that cost €80,000! Look, we can make a deal: you keep your precious watches, I’ll keep the apartment.
Pierre : €80,000 against €225,000? Are you kidding! There’s still €145,000 missing!
Maître Dubois : And your bank accounts? Your investments?
Marie : We have a livret A with €15,000, and Pierre has his PEL with… how much again?
Pierre : €35,000. Oh, and I almost forgot: I also have my shares in my brother’s company.
Marie : Oh really? Since when? You never told me about that!
Pierre : Uh… for the past six months. Well, it’s not much, you know! Just €20,000 in shares.
Maître Dubois : You’ll have to declare all of that, Pierre. No secrets in a divorce!
Marie : Well, well! What else are you hiding? I’m beginning to wonder if we can really do this amicably…
Pierre : Come on, Marie, it’s nothing at all! Okay, listen, let’s do it like this: you buy out my share of the apartment for €180,000, I keep my watches and my shares. Is that okay with you?
Marie : €180,000? And where am I supposed to find that? My sister can lend me €50,000, maximum.
Maître Dubois : You could apply for a bank loan to cover the difference. Or spread the payment out over several years.
Marie : Pierre, would you accept me paying you €130,000 in three installments? €50,000 right away, then the rest…
Pierre : Yeah… at least with interest!
Marie : Interest? Between us? Really?
Pierre : Well, what? That’s only fair! Come on, 2% per year is reasonable.
Marie : All right then, but you give up the Normandy house for good. And you take your things that are still lying around in the apartment.
Maître Dubois : Perfect! We’re making progress. And what about the furniture? The car?
Pierre : The BMW is mine! I paid for it with my salary.
Marie : Great! I’ll keep the Clio and the living room furniture. You can take back your giant TV.
Pierre : And my hi-fi system! Oh, and the barbecue too.
Marie : The barbecue? For your studio? Are you going to grill your steaks on the balcony?
Pierre : You never know, huh! Alright then, Maître Dubois, can we write all that up?
Maître Dubois : Of course. I’ll prepare the settlement agreement. Marie keeps the apartment in exchange for €180,000 paid in three installments with interest, Pierre gets back his personal belongings…
Marie : Phew! In the end, we’re not doing too badly. Thanks, Pierre, for making an effort.
Pierre : You’re welcome. At least the children will have some stability. That’s the main thing, isn’t it?
Maître Dubois : Very well! See you next week to sign the final documents.
